Senate Committee Calls on ARNECC to Urgently Release Reviews

Sympli welcomes the Senate Inquiry report handed down last Friday into competition reforms in eConveyancing by the Senate Standing Committee on Economics.
The report again confirmed the importance of interoperability to ensure resiliency and choice for industry and the wider economy, including the role of Government to deliver this reform.
One key recommendation was to call on ARNECC to urgently make the functional requirements and updated cost-benefit analysis reviews publicly available and to provide these to the ACCC, Treasurer, Assistant Minister for Competition and the Commonwealth Senate as soon as possible.
“The committee urges ARNECC to move swiftly to complete these reviews and publish them. The committee hopes that these reviews can provide some direction and clarity about the best way forward for the e-conveyancing sector, whether that includes interoperability or a different system for bringing competition into the sector.”1
Sympli calls on ARNECC to release these reports as soon as possible in line with this recommendation. Our industry needs that clarity on the pathway forward.
The Senate also recommended additional Commonwealth resources to assist the States to deliver the competition reforms as well as measures to improve resiliency of the overall sector, these include:
Recommendation 1: ARNECC to invite ACCC to have a permanent presence on the Council
Recommendation 2: ACCC investigate the eConveyancing market and report findings
Recommendation 4: Australian Government to reviews measures to improve reliability and resiliency
Recommendation 5: National Competition Policy reforms by the Australian Government consider eConveyancing in a future tranche
Recommendation 6: APRA prioritise auditing of banking institutions compliance with APRA CPS 230 and publish a report by 30 June 2026
These recommendations are a strong endorsement of the need for greater competition and resilience in Australia’s property settlement market:
“The committee also understands the concerns raised in evidence about the risks and downsides of a monopolised e-conveyancing market. The committee was very mindful of the evidence provided by the ACCC and other witnesses about the risks of monopolies. Having carefully considered the various perspectives presented in this inquiry, it is clear to the committee that greater competition is needed in the e-conveyancing sector.”2
